1.1 -This contract (Contract) is a distance contract under article 50 and D.Lgs. 6 September 2005 n.206 ("Consumer Code"). This contract is stipulated between Finagricola Coop a.r.l. , situated in Battipaglia (SA) 84091V.le Spagna 4 Z.I., C.F. and Reg.Imp. of Salerno n.02189960657, Vat N. 02189960657 (Finagricola) and the consumer (Customer). The Contract is considered concluded as soon as Finagricola receives the customer order by internet from the website according to the modalities explained in art.3.

1.2 -These sales terms are valid for each order and are part of the contract. Any changes to this Contract are valid from the official publication and applied to orders received from that point. The last updated version is the one published on the website. The Customer should read the sells terms before sending the order. When the Customer sends his order, he accepts the sells terms automatically.


The prices of the products on the site refer to each single packaging, not to a single product, and can be changed without any notice. Prices are V.A.T. included. The transport costs will be charged separately, if not expressly specified.


The approximate time of delivery is 24/48 working hours after receipt of payment.


4.1 -Following to a buying request, an e-mail will be sent to Customer to confirm that the command has been taken into account and it will be confirmed or cancelled within 3 days. After that term the Contract is intended concluded.

4.2 -For the payment the customer can choose between the following terms :
a. Wire transfer in advance: along with the order confirmation the customer will receive the Bank details.
b. Credit Card: accepted bank cards are CartaSi, Visa and Mastercard.
c. Pay Pal.


5.1 -The goods will be sent soon after receipt of payment.

5.2 -The delivery will be made within 48 working hours in Italy, except Islands, some particular places and foreign Countries.

5.3 -Should the address be incorrect or missing any important data, the sender is exonerated from any responsibility for the unsuccessful delivery.

5.4 -In case the delivered products have been damaged during the transport, you can (1) claim it to the forwarding agent immediately by writing on the bill of lading that the goods are accepted with reserve of verifying their state and quantifying the damage in order to ask for the reimbursement. (2) reject the parcel if the forwarding agent refuses to record the damage on the bill of lading. In this case you have to inform us immediately about. In order to ask for the replacement of the goods damaged during the transport, it is necessary to send us a communication within 12 hours from the delivery.

Finagricola accepts orders within the limits of its stock-in-trade. Therefore the confirmation of the Customer's command depends on the availability of the products in stock. Finagricola will inform the Customer immediately, if the requested product is not in stock at the moment of the order.


For the purchased products Finagricola is liable to the laws and rules of warranty and assistance relevant to the sale of consumer goods.


The Customer declares and assures: (i) that he is a consumer as ruled by art. 3 of the Code of Consumption; (ii) to be of age; (iii) that the transmitted data for the fulfilment of the Contract are correct and true.


9.1 -The Customer has the right to withdraw from the Contract, without any penalties and other specified reasons within 5 days from the receipt of the goods. The Customer is allowed to refuse the goods by a written communication to Finagricola, see art. 4, by means of a registered letter with acknowledgement of receipt, or by telegram, by mail or telex.

9.2 -The Customer who wants to make use of the right to withdraw must return the products to the address specified on the invoice, following the instructions, within 5 days from the receipt of the parcel. As indicated in art. 55, second paragraph of the Code of Consumption, the Customer has not the right to withdraw if the supplied products were manufactured to measure or custom-made, or if due to their perishable nature, they cannot be sent back (f. ex. foodstuffs).

9.3 -The transport costs for the return of the products are at Customer's charge and will not be reimbursed. Finagricola will pay back within 30 days from the return of products: (i) the whole sum paid by the Customer if the products are complete of all the pieces and cans; (ii) or the equivalent part of the value if the Customer has kept some cans or damaged the product so that it has lost its value or cannot be sold again.

The Contract is regulated by the Italian law. Every dispute relevant to the application, execution, violation of the Contract will fall under the competence of the Court where the Customer has his residence or domicile, if situated in Italy; if the Customer has his domicile abroad, place of jurisdiction will be the Court of Salerno.


If Finagricola is not able to respect the agreed times of the Contract, it will not be liable for inefficiencies owing to circumstances beyond its control, whatever nature they should be. Circumstances beyond one's control are considered, for instance, Legal Authority measures, strike of its dependents or of the forwarding agents it makes use, or any other circumstances beyond its control.
