SALES CONDITIONS

1. CONTRACT DEFINITION

1.1 -This contract (Contract) is a distance contract under article 50 and D.Lgs. 6 September 2005 n.206 ("Consumer Code"). This contract is stipulated between Finagricola Coop a.r.l. , situated in Battipaglia (SA) 84091V.le Spagna 4 Z.I., C.F. and Reg.Imp. of Salerno n.02189960657, Vat N. 02189960657 (Finagricola) and the consumer (Customer). The Contract is considered concluded as soon as Finagricola receives the customer order by internet from the website www.cosicome.eu according to the modalities explained in art.3.

1.2 -These sales terms are valid for each order and are part of the contract. Any changes to this Contract are valid from the official publication and applied to orders received from that point. The last updated version is the one published on the website. The Customer should read the sells terms before sending the order. When the Customer sends his order, he accepts the sells terms automatically.

2.PRICES

The prices of the products on the site refer to each single packaging, not to a single product, and can be changed without any notice. Prices are V.A.T. included. The transport costs will be charged separately, if not expressly specified.

3. ORDERS

The approximate time of delivery is 24/48 working hours after receipt of payment.

4. CONDITIONS OF PURCHASE AND PAYMENT

4.1 -Following to a buying request, an e-mail will be sent to Customer to confirm that the command has been taken into account and it will be confirmed or cancelled within 3 days. After that term the Contract is intended concluded.

4.2 -For the payment the customer can choose between the following terms :
a. Wire transfer in advance: along with the order confirmation the customer will receive the Bank details.
b. Credit Card: accepted bank cards are CartaSi, Visa and Mastercard.
c. Pay Pal.

5.DELIVERY OF THE PRODUCTS - CLAIMS

5.1 -The goods will be sent soon after receipt of payment.

5.2 -The delivery will be made within 48 working hours in Italy, except Islands, some particular places and foreign Countries.

5.3 -Should the address be incorrect or missing any important data, the sender is exonerated from any responsibility for the unsuccessful delivery.

5.4 -In case the delivered products have been damaged during the transport, you can (1) claim it to the forwarding agent immediately by writing on the bill of lading that the goods are accepted with reserve of verifying their state and quantifying the damage in order to ask for the reimbursement. (2) reject the parcel if the forwarding agent refuses to record the damage on the bill of lading. In this case you have to inform us immediately about. In order to ask for the replacement of the goods damaged during the transport, it is necessary to send us a communication within 12 hours from the delivery.

6.PRODUCTS AVAILABILITY

Finagricola accepts orders within the limits of its stock-in-trade. Therefore the confirmation of the Customer's command depends on the availability of the products in stock. Finagricola will inform the Customer immediately, if the requested product is not in stock at the moment of the order.

7.WARRANTY AND ASSISTANCE

For the purchased products Finagricola is liable to the laws and rules of warranty and assistance relevant to the sale of consumer goods.

8.DUTIES OF THE CUSTOMER

The Customer declares and assures: (i) that he is a consumer as ruled by art. 3 of the Code of Consumption; (ii) to be of age; (iii) that the transmitted data for the fulfilment of the Contract are correct and true.

9.RIGHTS OF WITHDRAWAL

9.1 -The Customer has the right to withdraw from the Contract, without any penalties and other specified reasons within 5 days from the receipt of the goods. The Customer is allowed to refuse the goods by a written communication to Finagricola, see art. 4, by means of a registered letter with acknowledgement of receipt, or by telegram, by mail or telex.

9.2 -The Customer who wants to make use of the right to withdraw must return the products to the address specified on the invoice, following the instructions, within 5 days from the receipt of the parcel. As indicated in art. 55, second paragraph of the Code of Consumption, the Customer has not the right to withdraw if the supplied products were manufactured to measure or custom-made, or if due to their perishable nature, they cannot be sent back (f. ex. foodstuffs).

9.3 -The transport costs for the return of the products are at Customer's charge and will not be reimbursed. Finagricola will pay back within 30 days from the return of products: (i) the whole sum paid by the Customer if the products are complete of all the pieces and cans; (ii) or the equivalent part of the value if the Customer has kept some cans or damaged the product so that it has lost its value or cannot be sold again.

10.PROCESSING OF PERSONAL DATA AND INFORMATIVE REPORT AS PER D.LGS. 196/03

10.1 According to Art. Nr. 196 of D.Lgs. of June, 30th 2003, of the Code of personal data security (later on called "Code"), we inform you that the personal data you provided us will be treated from Finagricola, both in Italy and abroad, through electronic and manual instruments by the full respect of the Code and of the law in force in matter of privacy.

Aim of the processing

The data collected will be used for the following purposes:

a. to sign up the service;
b. to conclude deed of sale and realize the benefits;
c. to implement the necessary fulfilments to give performance to the Contract;
d. to send commercial information, advertising, informative and promotional material by any means (e-mail, sms, ect.);
e. to make market research, economic and statistic analysis even by phone call, in order to verify the good;
f. To elaborate information about the Consumers' habits and trends ;
g. To communicate the data to third societies for direct marketing..

The entering of Customer personal data is mandatory for the settlement of the supply Contract, optional in the other cases. The missing of the private data will not allow the supplying of the requested goods.

Third parties to whom the data will be transmitted

Confidential data, for the aims above mentioned, could be processed by natural or juridical persons, in Italy and abroad, who on behalf of Finagricola provide specific services or carry out linked or instrumental activities.Confidential data, for the aims above mentioned, could be processed by natural or juridical persons, in Italy and abroad, who on behalf of Finagricola provide specific services or carry out linked or instrumental activities.

Therefore, for the same aims your data could be transmitted to:

- anybody who could have legal access to confidential information (such as: Public Authority);
- any addressee of information necessary to fulfil the duties of the Contract;
- third societies specialized in processing information relevant to commerce or to the credit (such as: data processing centres, banks, ect.)

Your data will be transmitted furthermore to:

- societies and/or partners for the administrative data management which are necessary to fulfil the contractual or legal obligations;
- other subjects (companies, societies, natural persons) who cooperate to the fulfilment of the services and of the aims specified, even abroad.

The above subjects work as responsible duly appointed and learned.

Preservation of data

Every data cannot be used for different aims apart from those above mentioned and will be preserved for the time necessary to fulfil them. After that time the data will be cancelled or rendered anonymous. The data on buying and services will be preserved only within the time established by the law in force.

Rights of the Customer

The Customer has free access to its private data at any time, as established by art. 7 (Right to enter one's private data and other rights) of the Code, in particular: the right to enter one's private data to modify, update or delete them if incomplete, wrong or collected against the law in force. Furthermore, he can not authorize its processing for legitimate reasons, by sending a written request to Finagricola, following the instructions indicated on the web site in the page of data entering.

11. PLACE OF JURISDICTION

The Contract is regulated by the Italian law. Every dispute relevant to the application, execution, violation of the Contract will fall under the competence of the Court where the Customer has his residence or domicile, if situated in Italy; if the Customer has his domicile abroad, place of jurisdiction will be the Court of Salerno.

12. LIABILITY

If Finagricola is not able to respect the agreed times of the Contract, it will not be liable for inefficiencies owing to circumstances beyond its control, whatever nature they should be. Circumstances beyond one's control are considered, for instance, Legal Authority measures, strike of its dependents or of the forwarding agents it makes use, or any other circumstances beyond its control.
